Statute of Limitations (3 Years) · 诉讼时效(三年)
Article 188 — Civil Code of the PRC — General Provisions (2021)
The limitation period for requesting protection of civil rights from the people's court is three years, unless otherwise provided by law.
The limitation period is calculated from the date on which the right holder knows or should have known that the right has been damaged and who the obligor is, unless otherwise provided by law. However, the people's court shall not protect rights where more than twenty years have elapsed since the damage occurred; under special circumstances, the court may extend the period upon application of the right holder.
