In addition to exercising the right of defense themselves, criminal suspects and defendants may also entrust one or two persons as defense counsel. The following persons may be entrusted as defense counsel:
(1) Lawyers;
(2) Persons recommended by people's organizations or the unit where the criminal suspect or defendant works;
(3) Guardians, relatives, and friends of the criminal suspect or defendant.

Persons who are serving criminal sentences or have been deprived of or restricted in personal freedom according to law may not serve as defense counsel.

犯罪嫌疑人、被告人除自己行使辩护权以外，还可以委托一至二人作为辩护人。下列的人可以被委托为辩护人：
（一）律师；
（二）人民团体或者犯罪嫌疑人、被告人所在单位推荐的人；
（三）犯罪嫌疑人、被告人的监护人、亲友。

正在被执行刑罚或者依法被剥夺、限制人身自由的人，不得担任辩护人。
