Foreigners who reside in China illegally shall be given a warning; where circumstances are serious, they shall be fined ¥500 per day of illegal residence, up to a total of ¥10,000, or detained for 5 to 15 days.

Where a foreigner under 16 resides illegally due to reasons attributable to a guardian, the guardian shall be given a warning and may be fined up to ¥1,000.

(Note: Staying beyond the expiry of your visa or residence permit constitutes illegal residence. If you are about to overstay for special reasons, proactively apply for an extension at the exit-entry administration before expiry. Voluntary reporting is usually treated more leniently.)

外国人非法居留的，给予警告；情节严重的，处每非法居留一日五百元、总额不超过一万元的罚款或者五日以上十五日以下拘留。

因监护人或者其他负有监护责任的人的原因，致使未满十六周岁的外国人非法居留的，对监护人或者其他负有监护责任的人给予警告，可以并处一千元以下罚款。

（注：签证或居留许可到期后继续停留即构成非法居留。如因特殊原因即将逾期，应在到期前主动到出入境管理部门申请延期。主动报告通常处理较轻。）
