Disturbing Public Order · 扰乱公共秩序
Article 26 — Public Security Administration Punishments Law of the PRC (2025 revision, in force 1 Jan 2026)
Whoever commits any of the following shall be given a warning or fined up to ¥500; where the circumstances are relatively serious, detention of 5 to 10 days plus a possible fine of up to ¥1,000 applies:
(1) Disturbing the order of a government body, organisation, enterprise or institution so that work, production, business, medical care, teaching or research cannot proceed normally, without causing serious loss;
(2) Disturbing order at a station, port, wharf, airport, shopping centre, park, exhibition hall or other public place;
(3) Disturbing order on a bus, tram, urban rail vehicle, train, ship, aircraft or other public transport;
(4) Unlawfully blocking or forcibly boarding a vehicle, ship, aircraft or other transport so as to affect its normal operation;
(5) Disrupting the order of a lawful election.
Where the act is committed by a crowd, ringleaders face 10 to 15 days’ detention and a possible fine of up to ¥2,000.
(Update: this is Article 26 of the revised Law in force from 1 January 2026 — formerly Article 23. Fines rose from ¥200 to ¥500 and from ¥500 to ¥1,000; urban rail vehicles and the crowd-ringleader rule are new.)
有下列行为之一的,处警告或者五百元以下罚款;情节较重的,处五日以上十日以下拘留,可以并处一千元以下罚款:
(一)扰乱机关、团体、企业、事业单位秩序,致使工作、生产、营业、医疗、教学、科研不能正常进行,尚未造成严重损失的;
(二)扰乱车站、港口、码头、机场、商场、公园、展览馆或者其他公共场所秩序的;
(三)扰乱公共汽车、电车、城市轨道交通车辆、火车、船舶、航空器或者其他公共交通工具上的秩序的;
(四)非法拦截或者强登、扒乘机动车、船舶、航空器以及其他交通工具,影响交通工具正常行驶的;
(五)破坏依法进行的选举秩序的。
聚众实施前款行为的,对首要分子处十日以上十五日以下拘留,可以并处二千元以下罚款。
(更新提示:本条为2026年1月1日起施行的新版第二十六条,原第二十三条。罚款由二百元提高至五百元、五百元提高至一千元;新增“城市轨道交通车辆”,并新增聚众实施的加重规定。)

Foreign Crew Wages Recovered — Ship Arrested and Released in 9 Days

A Liberian ship-management company, owed US$656,400 in crew-management fees by a Marshall Islands shipowner, applied to a Chinese maritime court to arrest the ship when it called at Quanzhou port. The court arrested the 70,000-ton foreign vessel within 24 hours and brokered a US$762,800 settlement in just 9 days; the crew's pay was covered and the ship was released before a typhoon arrived.

Carrier May Not Invoke Foreign Sanctions to Refuse Cargo
承运人不得以外国制裁为由拒运案
A Hong Kong shipper booked electronics worth about ¥4.99 million from Shanghai to Panama. The Singapore carrier refused to issue the bill of lading, citing the shipper's inclusion on a foreign sanctions list, and later shipped the cargo back. Applying China's Anti-Foreign Sanctions Law, the court held this was a fundamental breach and awarded the shipper full damages plus interest.
