Article 58: An employer shall apply for social insurance registration for its employees with the social insurance agency within 30 days from the date of employment.

Article 97: Foreigners employed within the territory of China shall participate in social insurance with reference to the provisions of this Law.

(Note: When a foreign employee leaves China, their individual social insurance account is retained; if they return to work in China, contribution years accumulate. Upon written application, the social insurance relationship may be terminated and the balance of the individual account paid out in a lump sum.)

第五十八条 用人单位应当自用工之日起三十日内为其职工向社会保险经办机构申请办理社会保险登记。

第九十七条 外国人在中国境内就业的，参照本法规定参加社会保险。

（注：外籍员工离开中国时，其社会保险个人账户予以保留，再次来华就业的，缴费年限累计计算；经本人书面申请，也可以终止社会保险关系，个人账户储存额一次性支付给本人。）
