For motor-vehicle accidents, the compulsory traffic insurance (jiaoqiangxian) pays first up to its limits. Any excess: between motor vehicles, shared by degree of fault; between a motor vehicle and a cyclist/pedestrian, the motor-vehicle side is liable, reduced if the cyclist/pedestrian was at fault; if the motor-vehicle side is entirely without fault, it still bears up to 10%.

机动车发生交通事故造成人身伤亡、财产损失的，先由保险公司在交强险责任限额内赔偿；不足部分：机动车之间按过错比例分担；机动车与非机动车、行人之间，由机动车一方承担赔偿责任，但有证据证明非机动车、行人有过错的，可减轻机动车一方责任；机动车一方无过错的，承担不超过10%的赔偿。
