The Supreme People's Court's Interpretation II on road-traffic accident compensation cases (Fa Shi [2026] No. 9, 12 articles) took effect on 30 June 2026. Key rules: where a rented or borrowed vehicle causes an accident, the user bears liability, and the owner shares liability only within the scope of the owner's own fault; a passenger's “door-strike” (opening a door into a passer-by) counts as the motor-vehicle side's liability, so compulsory (jiaoqiangxian) and commercial third-party insurance must pay first; in free-ride (“goodwill lift”) accidents the driver's liability is reduced unless there is intent or gross negligence; lost-income damages are available even to victims past statutory retirement age if actual loss is proven. The Interpretation applies to pending cases not yet finally decided.

最高人民法院《关于审理道路交通事故损害赔偿案件适用法律若干问题的解释（二）》（法释〔2026〕9号）自2026年6月30日起施行，共12条。要点：租赁、借用机动车发生事故的，由使用人承担赔偿责任，车主对损害发生有过错的，在过错范围内共同担责；乘车人“开门杀”致人损害属于机动车一方责任，交强险和商业三者险应先行赔付；“好意同乘”（无偿搭乘）发生事故，除驾驶人有故意或重大过失外应减轻其责任；受害人超过法定退休年龄但能证明实际误工损失的，误工费应予支持。本解释施行后尚未终审的案件适用本解释。
